Terms of Service
1. Introduction
These Terms of Service outline the conditions under which TrustedPsych will provide psychiatric assessment and report services to the Instructing Party. By engaging with TrustedPsych, the Instructing Party agrees to comply with the terms stated herein.
2. Scope of Services
Case Submission: The Instructing Party must submit an enquiry via TrustedPsych's online form, email, or video call, providing a brief description of the case, the patient's age, historical psychiatric diagnoses, and the required deadline. Additionally, the Instructing Party must specify the number of questions to be answered and the number of pages of supporting documents, including medical records and relevant legal documentation.
Document Submission: TrustedPsych will provide a secure link for uploading sensitive data. The Instructing Party must submit a letter of instruction, all relevant medical records, and any pertinent legal documentation by the 'document submission deadline.' Failure to meet this deadline may result in postponement or cancellation of the assessment.
Booking Confirmation: Upon verifying that TrustedPsych can meet the Instructing Party’s requirements, TrustedPsych will assign a psychiatrist to the case and confirm three key dates:
- Assessment Date: The date on which the psychiatrist will conduct the psychiatric assessment via Google Meet.
- Document Submission Deadline: The final date by which all supporting documents must be uploaded.
- Report Submission Deadline: The target date by which the completed report will be submitted to the Instructing Party.
3. Service Delivery
Assessments: All assessments will be conducted remotely via Google Meet or an equivalent video meeting platform. The Instructing Party will receive a calendar invite with the meeting link once all supporting documents have been received. The Instructing Party can include additional participants, such as a patient, carer, or interpreter, by sharing the meeting link.
Report Submission: TrustedPsych will notify the Instructing Party via email once the report is completed. While TrustedPsych strives to meet the report submission deadline, this date is not guaranteed and may vary depending on the complexity of the case and the volume of documents provided. TrustedPsych will communicate any potential delays promptly.
4. Fees and Payment Terms
Fee Structure: Fees are determined based on the information provided at the time of the enquiry, including the complexity of the case and the number of questions and documents submitted. Any changes in the scope of work may result in additional fees, which will be agreed upon with the Instructing Party before proceeding.
Payment Terms: The Instructing Party is responsible for payment unless agreed otherwise. Invoices will be sent on the day the report is submitted, and payment is due within 30 days (Net 30). Failure to pay invoices on time may result in interest being charged at 8% above the Bank of England base rate, as well as the recovery of any additional costs associated with debt collection. If the client of the Instructing Party is responsible for payment, TrustedPsych requires full payment in advance of the assessment date.
No Win, No Fee: TrustedPsych does not accept cases on a "no win, no fee" basis.
5. Cancellation Policy
72-Hour Cancellation Policy: If the Instructing Party cancels an assessment less than 72 hours before the scheduled time, the Instructing Party will be liable to pay for the 2-hour assessment at a cost of £135 per hour. Where an interpreter is provided for the assessment by TrustedPsych, the full cost associated with the interpreter will be charged in addition. Cancellation must be communicated in writing via email to TrustedPsych, and the cancellation time will be determined by the timestamp on the email received by TrustedPsych.
6. Responsibilities and Limitations
Instructing Party’s Responsibilities: The Instructing Party must provide complete and accurate information, including all relevant medical and legal documentation. Any material misrepresentation or omission by the Instructing Party may compromise the psychiatrist's report, for which TrustedPsych will not be held responsible. However, TrustedPsych will take reasonable steps to clarify and verify the information provided.
Psychiatrist’s Role: The assigned psychiatrist will provide assessment and treatment recommendations based solely on the initial assessment and the provided documentation. All TrustedPsych psychiatrists are registered with the General Medical Council (GMC) and adhere to the GMC Code of Ethics and Conduct.
Complaints: Any complaints regarding the assessment, report, treatment, conduct, or ethics should be directed to TrustedPsych in the first instance. Complaints will be acknowledged within 7 days, and a formal response will be provided within 30 days. Issues related to a psychiatrist's recommendations are subject to a separate agreement between the Instructing Party and the psychiatrist, which is implied based on the conduct and communications of the parties. TrustedPsych disclaims all responsibility and liability for any disputes or claims arising from or related to the psychiatrist's recommendations, which shall be resolved directly between the Instructing Party and the psychiatrist.
7. Confidentiality and Data Security
Data Protection: TrustedPsych is committed to ensuring the security and confidentiality of all client data. Documents should be submitted via the secure link provided by TrustedPsych to protect sensitive information. TrustedPsych complies with the General Data Protection Regulation (GDPR) and other applicable data protection laws.
8. Amendments and Termination
No Variations: TrustedPsych cannot accept unilateral variations to these terms. Any variations must be mutually agreed upon in writing by both parties. Any attempt to unilaterally alter a psychiatrist's report by the Instructing Party is prohibited.
Termination: TrustedPsych reserves the right to terminate services if the Instructing Party fails to meet payment obligations, provides incomplete documentation, or breaches any terms of these Terms of Service. Termination will be preceded by a written notice outlining the breach and providing a 7-day period to remedy the situation.
9. Limitation of Liability
Limitation of Liability: TrustedPsych's liability to the Instructing Party for any breach of these Terms of Service, or any negligence, error, or omission in the provision of services, shall be limited to the fees paid by the Instructing Party for the specific service provided.
Exclusion of Consequential Damages: Under no circumstances shall TrustedPsych be liable for any indirect, consequential, or incidental damages, including but not limited to loss of profits, business, or data, arising out of or in connection with the services provided, even if TrustedPsych has been advised of the possibility of such damages.
Professional Liability: TrustedPsych shall not be liable for any professional errors or omissions by the psychiatrist assigned to the case, as the psychiatrist operates under the guidance and standards of the General Medical Council (GMC). The Instructing Party acknowledges that any claims related to professional conduct should be directed to the psychiatrist and addressed through the appropriate professional channels.
Force Majeure: TrustedPsych shall not be liable for any failure or delay in performance of its obligations under these Terms of Service due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, labor disputes, governmental regulations, or any other force majeure event.
10. Agreement
These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms of Service will be resolved under the jurisdiction of the courts of England and Wales.
By engaging in services with TrustedPsych, the Instructing Party acknowledges and agrees to the terms set forth in these Terms of Service.
11. Entire Agreement
Entire Agreement: These Terms of Service, together with the Letter of Instruction provided by the Instructing Party, constitute the entire agreement between the parties concerning the subject matter hereof. This agreement supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written, between the parties. No amendment to this agreement shall be effective unless it is in writing and signed by both parties.
